Frio County Bench Warrants Explained
“Bench warrant” is a common label for a judge's arrest process after a missed setting or failure to meet a court order. Frio County lower courts may instead use “alias warrant” or “capias pro fine.” The court named on the citation, bond, summons, or docket is the place to confirm which one applies.
Pearsall lists specific triggers: no court appearance, no ticket response within 20 working days, a defaulted payment arrangement, an unpaid judge-assessed fine, driver-safety-course or show-cause failure, probation revocation, and failure to complete community service. These are Pearsall rules, not an automatic list for every Frio court.
Frio County Bench Warrant Triggers
A missed appearance and an unpaid post-judgment fine are not the same event. An alias arrest warrant can follow a failure to appear before answering a charge; a capias pro fine follows judgment and unpaid fines or costs. Ask the court which stage the case reached, because paying a balance may not replace a required hearing or judge's order.
For a Pearsall citation, the clerk can explain the city's published categories and fee. For a Dilley or JP matter, the local pages do not publish the same detailed trigger list. Do not apply Pearsall's $50 per-case warrant fee or its 20-working-day ticket rule to another court without confirmation.
How Frio County Bench Warrants Are Issued
The court that set the underlying case decides whether a missed setting or unpaid judgment calls for further process. The clerk keeps the case file; a sheriff, constable, city police officer, or marshal may receive the service copy. Frio's public pages do not publish one assignment chart or a countywide bench-warrant database.
After issuance, ask the court whether the process is still active, whether bond or a new setting is required, and how a recall is sent to the serving agency. A docket entry may show that an order was made without proving that every downstream system has updated.
Frio County Capias Pro Fine Is Different
A capias pro fine is a post-judgment writ for unpaid fines and costs, not simply an overdue online bill. Texas Code of Criminal Procedure Chapter 45A addresses hardship hearings and recall when a person gives notice, obtains a hearing, or voluntarily appears and makes a good-faith effort to resolve the judgment. The issuing judge applies those rules to the case.
Pearsall calls this category “Capias Pro-Fine” and assesses a $50 warrant fee on each case where a warrant is ordered. No equivalent city fee or detailed recall schedule was located for Dilley or the Frio JPs. Ask for the itemized amount and the court's written recall status.
Read the current Chapter 45A provisions before relying on a general explanation; the court must confirm what applies in an individual case.
Bench Warrants and Arrest Warrants Compared
A bench-style process responds to a court obligation in an existing case. An arrest warrant authorizes arrest on a criminal accusation after a magistrate's probable-cause review. Either may be served by an authorized peace officer, but the triggering record and the court's next step differ. Frio's issuing court controls the local label.
| Feature | Bench Warrant | Arrest Warrant |
|---|---|---|
| Trigger | Missed setting or court-order noncompliance. | Probable cause in a criminal complaint or affidavit. |
| Who Issues It | Judge in the court holding the existing case. | Magistrate or court under Texas procedure. |
| Underlying Case | Usually an existing citation or court case. | A criminal accusation or charging process. |
| How It Clears | Follow the court's payment, hearing, bond, or recall order. | Confirm the issuing court's bond, appearance, and case steps. |
Frio County Warrant Courts in Dilley
Dilley has two distinct court addresses. JP4 is at 101 North Commerce Street, Suite 101; Dilley Municipal Court is at City Hall, 116 East Miller. A citation that says Dilley does not identify which court owns the file. Use the court name and case number, not only the city name.
The county JP page lists 830-326-3250 for JP4, while the Texas Judicial Branch directory lists 830-965-2009. The municipal court page gives 830-965-1624; its statewide directory row gives 830-965-1733. Verify the current number on the official office page before relying on it.
The county JP contact page shows the separate precinct structure. It does not provide a combined bench-warrant list.

The precinct page is a routing aid. The issuing JP still needs to confirm a specific case and recall.
JP4 Bench Warrant Contacts Conflict
JP4 is at 101 North Commerce Street, Suite 101, Dilley. The county's JP directory lists 830-326-3250, while the Texas Judicial Branch directory lists 830-965-2009. Those sources do not explain the discrepancy. Use the precinct printed on the case, verify the current contact with the court, and ask the clerk to confirm the warrant and any recall in the JP4 record.
The county Justice of the Peace page and the state court directory provide the two published routes.
Resolving a Frio County Bench Warrant
Use the issuing court's current instructions. Frio County does not publish a general walk-in docket, safe-surrender window, county bond schedule, or recall form. A lawyer can ask for a setting or file a motion; a person without counsel should ask the clerk what filing and appearance steps the judge requires.
- Call the court printed on the citation or docket and confirm the process type and status.
- Ask whether a hearing, bond, payment, attorney appearance, or motion is required.
- Get the current amount and accepted route from the court; a vendor receipt alone may not recall process.
- Ask when the court will update the sheriff, regional system, or DPS, then request confirmation.
Caution: Do not assume a warrant disappears with time or a payment. Confirm the issuing court's status and any service-system update before relying on a receipt.
Frio County Capias Recall Rules
For a post-judgment capias pro fine, ask whether the court has considered hardship and what good-faith resolution it will accept. A payment plan, community service, hearing, or other order depends on the court and the judgment. Frio's source set did not locate a county motion form or a uniform fee for recall.
For a JP ticket, use the precinct on the citation. For a city matter, call the municipal court. For a felony setting, contact the District Clerk or the 81st/218th coordinator and identify Frio County because that district serves five counties. Ask for the case-specific direction before appearing.
Finding the Court That Issued the Warrant
A Frio County bench warrant stays with the court that set the underlying case. The sheriff can answer a service or booking-routing question, but it cannot substitute for the judge's recall order. A city ticket points to Pearsall or Dilley Municipal Court; a precinct citation points to the named JP; a felony cause points to the District Court and District Clerk.
For felony routing, the 81st/218th District Court site lists coordinator contact details and serves Frio along with four other counties. Call 830-769-3750 or use coordinator@81-218.txcourts.gov with the county and cause number. The Frio County warrant lookup page maps the other court and sheriff channels.
